1. Parties and scope
These terms and conditions («terms») apply to all services of Neustonorix B.V. («Neustonorix», «we»), Overtoom 282, 1054 GZ Amsterdam, KvK 62244243, VAT NL840566347B01. Contact: 020 248 3164, [email protected], contact form.
They cover recording, mixing, mastering, podcast/audiobook work and music production as described on services and in your quote. A tour, informal chat or contact form message alone does not create a contract. See also our legal notice and disclaimer.
2. Definitions
| Term | Meaning |
|---|---|
| Client | The natural or legal person who accepts a quote — consumer or business. |
| Consumer | A natural person acting outside their trade, business or profession. |
| Business client | A company, label, publisher, agency or other organisation booking in a professional context. |
| Quote | The written document stating the service, date, duration, price including and excluding VAT, deposit and any special terms. |
| Session | The reserved studio time with an engineer, or the agreed delivery moment for a remote service. |
| Business day | Monday to Friday, excluding public holidays in the Netherlands. |
| Deposit | 25% of the quoted price including VAT, due when the booking is confirmed. |
| Force majeure | Circumstances beyond our reasonable control that temporarily or permanently prevent performance. |
3. Quotes, contract formation and pre-contract information
Requests via contact, 020 248 3164 or [email protected] receive a quote within 2 business days unless we say otherwise. Quotes are valid for 30 days unless a different period is stated.
The contract is formed when you accept the quote in writing (email, signature) and pay the deposit. Until then, a provisional slot is not firmly held. For distance contracts we confirm the booking by email with the essential quote details.
The site shows indicative rates, for example €68 per studio hour for vocal recording or €235 per track for mixing. The accepted quote prevails if amounts differ. Practical questions are in the FAQ.
4. Prices and VAT
Prices on the website and in quotes are in euros. Consumer prices include 21% VAT unless stated otherwise. For business clients we also show excluding-VAT amounts where relevant (for example €56.20 per studio hour).
Extra studio time beyond the booked block is charged only with your oral or written approval, per started half hour at the service rate. Optional items (DDP €45, stems, extra formats) apply only if listed on the quote or ordered in writing.
5. Deposit, payment and set-off
The deposit is 25% of the agreed price including VAT and is offset against the balance. Payment is by bank transfer; in the studio we accept card payment for the balance where available.
Consumers pay the balance on the session day or when final files are delivered for remote services (mix, master, podcast finishing). Business clients pay within 14 days of the invoice date unless the quote states otherwise.
If payment is late we may withhold delivery of final masters; session files remain archived as in article 10. Collection costs and statutory interest may be charged where permitted.
6. Reschedule and cancellation by the client
| Timing | Effect |
|---|---|
| More than 5 days before the session | Free reschedule or cancellation; on cancellation we refund the deposit within 14 days. |
| Between 5 days and 48 hours before | The deposit is applied once to a new date within 6 months; without a new date the deposit remains due. |
| Less than 48 hours before or no-show | The deposit remains due unless you prove force majeure on your side. |
Send requests by email to [email protected] or phone 020 248 3164, with written confirmation. Late arrival shortens the session if the next block is booked. These rules do not limit the consumer’s statutory withdrawal right (article 7).
7. Right of withdrawal (consumer, distance contract)
If you are a consumer and conclude a distance contract (email, phone, form) without visiting the studio, you generally have 14 days to withdraw without giving reasons, from the day the contract is concluded, subject to mandatory law.
If you ask us to start the session or a remote service before that period ends, you must do so explicitly. If you still withdraw, you pay a proportionate amount for what was delivered until then.
The withdrawal right expires once we have fully performed within the period, after you expressly agreed to immediate performance and acknowledged that the right expires upon full performance. It may also not apply to custom-made or clearly personalised productions (for example a bespoke production job).
Withdraw by an unambiguous statement to [email protected] or by post to Overtoom 282, 1054 GZ Amsterdam. We refund within 14 days using the same payment method unless agreed otherwise.
8. Cancellation or changes by Neustonorix
If we must cancel a session (equipment failure, engineer illness, incident on the premises), we notify you as soon as possible and offer a replacement time. If that does not work, we refund all amounts paid within 14 days.
We do not swap the booked engineer without discussion, except if the scheduled person is unavailable and a colleague with comparable skills can step in.
9. Studio sessions
Opening hours: Monday to Friday 09:00–21:00, Saturday 10:00–18:00, by appointment only. Up to 5 musicians at once in the live room (38 m²; vocal booth 8 m²). See band recording and our band budget guide.
Participants under 16 may take part only with written consent from a parent or guardian who books and pays; a responsible adult must be present throughout.
Use equipment and rooms carefully and follow engineer instructions. Smoking and vaping are not allowed on the premises. We may stop a session for unsafe behaviour; remaining time stays payable. Damage to studio gear through intent or gross negligence is charged to the client. Your own instruments and laptops remain your responsibility — insure them if needed.
We work at moderate monitor levels and provide earplugs. See also vocal preparation tips.
10. Files, delivery and archive
Unless the quote says otherwise, we deliver mix and master files as 24-bit WAV via download link or on media you supply. Remote services start once complete, usable source files are received; stated turnaround runs in business days from that point.
We keep session and project copies for 12 months after the last activity on the job, then delete them from active storage. Download and backup are your responsibility within that period. Longer retention can be agreed in writing for a separate fee.
Master format choices are explained in the master delivery guide and on mastering.
11. Revision rounds
Mixing and mastering each include 2 revision rounds as on the service pages. One round is a single bundled list of notes processed in one pass. Extra rounds or a new artistic direction after approving an intermediate version are quoted separately.
For stems and exports to external engineers, see the stems guide.
12. Intellectual property and usage rights
Your works. Compositions, lyrics and other material you supply remain yours or your licensors’. You warrant that you have the necessary rights on samples, covers and sheet material and handle collective management yourself.
Recordings. When you initiate and fund recording, you are generally the producer under neighbouring-rights rules. Neustonorix B.V. does not claim copyright on your music. Any neighbouring rights that might rest with us are assigned to you after full payment, to the extent permitted by law.
Studio material. Demos, beats or arrangements we create specifically for you remain our intellectual property until full payment; usage rights are set out in the quote. Music production always requires written allocation of master and performance rights.
Performers and speakers. Fixing and exploiting performances requires consent from artists, musicians or voice actors; arrange that before the session. For podcast and audiobook work, performance rights sit between publisher and narrator; we provide technical production.
References and AI. We do not use your recordings to train AI models and do not clone voices without separate written consent. We mention your project as a reference only with your written approval.
13. Liability
We perform services with professional studio care; artistic outcome also depends on your preparation and choices and is not a measurable guarantee. Our liability is limited to direct damage from attributable breach, except where mandatory law says otherwise.
Consumers retain all statutory rights, including for personal injury. For business clients, total liability per job — except intent or wilful recklessness — is capped at the invoice amount including VAT for that job; indirect loss and lost profit are excluded.
Background on expectations is in the disclaimer and FAQ.
14. Force majeure
In force majeure, parties need not perform the affected obligation while the situation lasts. The affected party informs the other as soon as possible. We first seek a new date; if hindrance lasts more than 28 days or rescheduling is unreasonable, either party may terminate and we refund prepaid amounts for services not yet delivered.
15. Personal data
We process personal data under our privacy policy. If you supply guest, narrator or band member data as a business client, our data processing agreement applies where needed. The contact form uses FormSubmit (United States); see the privacy policy for transfers and safeguards.
16. Complaints
Complaints about a service or invoice should be sent in writing to [email protected] with a short description and quote reference. We acknowledge receipt and respond within 2 business days with a proposed solution where possible.
If we cannot resolve the matter, consumers may bring a dispute before the competent court (article 17). EU online dispute platform: ODR platform. We are not obliged to join a sector complaints board outside court.
17. Governing law and disputes
These terms and contracts with consumers in the Netherlands are governed by Dutch law. Consumers may also rely on mandatory rules of the country where they habitually reside where the law requires.
We aim to resolve disputes amicably. If a dispute remains, the courts of Amsterdam have jurisdiction, subject to mandatory consumer forum rules.
18. Final provisions
If a clause is void or voidable, the rest remains in force; we replace the void clause with a valid one that best matches its purpose. Failure to enforce a right is not a waiver.
We may amend these terms; ongoing jobs keep the version in force when you accepted the quote. If languages differ, the Dutch text prevails. Effective from 15 October 2026; published on neustonorix.digital as of 15 October 2026.
